The following terms and conditions ("Terms") apply to all BluesBusters gift certificates ("Certificates") purchased through House of Blues ("HOB"). By purchasing, using or attempting to use any Certificate, you agree to these Terms, as well as our general Terms of Use (including the Purchase Policy and Privacy Policy referred therein). Any attempt to redeem a Certificate in violation of these Terms will render the Certificate void.
Certificates are not redeemable for cash, unless required by law. If cash redemption is required by applicable law, you will only be entitled to cash redemption based on the amount you paid for the Certificate, not the actual or retail cost of the products, services or experiences specified on the Certificate. Certificates may not be redeemed for products, services or experiences other than those specified on the Certificate. Some retail exclusions apply. Certificates may not be combined with any other offer, coupon, promotion, discount, or certificate and must be used in a single visit. HOB reserves the right to limit the number of Certificates you may purchase. Certificates are subject to any other limitations stated on the Certificate or otherwise by HOB.
Certificates may not be used for prior balances, shipping or handling, or other fees except as expressly provided on the Certificate. Unless otherwise stated, the Certificate price does not include sales, value added or use taxes, which may be charged to you separately at the time you redeem the Certificate. The issuance of any refunds or credits for the Certificate is at the sole discretion of HOB. Certificates may not be used in connection with any marketing, advertising, incentive or promotional activities, and the unauthorized or unlawful reproduction, resale, modification, or trade of Certificates is prohibited. HOB reserves the right to cancel a Certificate if it believes that you obtained the Certificate through fraudulent or unauthorized means. HOB is not responsible for lost or stolen Certificates. Certificates may have two separate values: (i) the amount you paid and (ii) the promotional value. The promotional value is the additional value beyond the amount you paid. For example, if you pay $20 for a Certificate that entitles you to $50 of products, services, or experiences, the amount you paid is $20 and the promotional value is $30. The amount you paid will not expire until it is used. The promotional value expires on the date stated on the Certificate.
If you don’t redeem your Certificate after a certain period of time, we may remit the cash associated with the unused balance to certain states pursuant to their abandoned property laws. Once we have remitted that cash to such a state, you may no longer be able to redeem the Certificate, and we may direct you to that state’s government instead. Certificates are not reloadable, meaning that the amount you paid for the Certificate cannot be increased.
All restaurant Certificates are valid for dine-in only unless otherwise stated on the Certificate. Certificates may not be used for taxes, gratuities or alcohol (where prohibited), except as expressly provided on the Certificate. Other restrictions may apply. You may use one Certificate per party per visit. You must present your Certificate in person to redeem.
Some Certificates are redeemable for a ticket for admission, or may be used as a ticket for admission, to a specific event at a named venue ("Admission Certificates"). Admission Certificates expire once the event date and time has passed. Admission Certificates are final sale and non-refundable. Unless a specific exception is made, Admission Certificates are not eligible for upgrades and are not transferable. Certain resale premiums and restrictions may apply. Admission Certificates obtained from unauthorized sources may be lost, stolen, or counterfeit, and if so are void.
You waive and release HOB and its affiliates and their respective officers, directors, employees, shareholders, agents and representatives, from any and all liabilities, damages, claims and rights of any nature whatsoever in connection with the Certificate including, without limitation, unclaimed property and escheatment laws.
